A RESOLUTION BY THE ATLANTA CITY COUNCIL
A RESOLUTION TO CALL AND CONDUCT A SPECIAL ELECTION MARCH 19, 2019 TO ELECT A SUCCESSOR TO
FILL THE VACANCY IN DISTRICT 3 OF THE ATLANTA CITY COUNCIL FOR THE UNEXPIRED TERM OF THE LATE COUNCILPERSON IVORY LEE YOUNG JR; TO CONDUCT A RUNOFF ELECTION IF NECESSARY TO BE HELD ON APRIL 16, 2019; AND FOR OTHER PURPOSES.
WHEREAS, The Office of Atlanta City Council District 3 representative has been vacated by
reason of the untimely death of Councilperson Ivory Lee Young Jr.; and
WHEREAS, Section 5-103 of the Charter of the City of Atlanta requires that, in the event the office of a councilmember shall become vacant by reason of death, the council shall, within 15 days after the occurrence of such vacancy, call a special election to fill the balance of the unexpired term of such office by giving notice thereof in on or more newspapers of general circulation within the city; and
WHEREAS, the current council term shall expire on December 31, 2021;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA,
HEREBY RESOLVES AS FOLLOWS, GEORGIA:
SECTION 1. That a special election shall be held on March 19, 2019 for the election of a City Council Member to fill the unexpired term of the late Councilmember Ivory Lee Young Jr. City Council District 3.
SECTION 2. That a run-off election, if necessary, shall be held on April 16, 2019.
SECTION 3. That all polls within City Council District 3 of the City of Atlanta shall be opened at 7:00 a.m. and shall remain open continuously until 8:00 p.m. for the special election and the runoff election, if one is necessary.
SECTION 4. That the names of candidates shall seeking election shall appear on the ballot alphabetically by last name without titles or party affiliations.
SECTION 5. That the Municipal Clerk/Election Superintendent shall “call” the Election by publishing notice of the election in a newspaper of appropriate general circulation.
SECTION 6. That the Municipal Clerk is Authorized to inter into a contract not to exceed one hundred twenty five dollars ($125,000.00) with the Fulton County Board of Elections and Registration who is hereby appointed as the Municipal Election Superintendent to conduct the election, to receive from poll officers the returns of the election, to canvass and compute such returns, to certify as soon as practicable following the election the results thereof to the Council, and to take such other actions in the premises as provided by law.
SECTION 7. That the Municipal Clerk is hereby ordered and directed forthwith to furnish the Municipal Election Superintendent of the City with a duly certified copy of this resolution in order that the Municipal Election Superintendent may take such action as provided by law.
SECTION 8. That all resolutions or parts of resolutions on conflict herewith are hereby repealed.
