A RESOLUTION

AS AMENDED BY COMMITTEE ON COUNCIL

 

A RESOLUTION TO CALL AND CONDUCT A SPECIAL ELECTION TO ELECT A SUCCESSOR TO FILL THE VACANCY IN DISTRICT 2 OF THE ATLANTA BOARD OF EDUCATION FOR THE UNEXPIRED TERM OF BYRON AMOS ON SEPTEMBER 17, 2019; TO CONDUCT A RUNOFF ELECTION IF NECESSARY TO BE HELD ON OCTOBER 15, 2019; AND FOR OTHER PURPOSES

WHEREAS, The Office of Atlanta Board of Education District 2 representative has been vacated by reason of the resignation of Byron Amos; and

WHEREAS, Section 2-109(d) of the Charter of the Atlanta Independent School System requires that, in the event a vacancy requiring a special election, the Board of Education shall, within 15 days after the occurrence of such vacancy, call a special election to fill the balance of the unexpired term of such office; and

WHEREAS, the current Board term shall expire on December 31, 2021; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES AS FOLLOWS, GEORGIA:

SECTION 1. That a special election shall be held on September 17, 2019 for the election a Board of Education Member to fill the unexpired term of Board of Education District 2.

SECTION 2. That a run-off election, if necessary, shall be held on October 15, 2019.

SECTION 3. That all polls within Education District 2 of the Atlanta Independent School District shall be opened at 7:00 a.m. and shall remain open continuously until 8:00 p.m. for the special election and the run-off election, if one is necessary.

SECTION 4. That the names of candidates seeking election shall appear on the ballot alphabetically by last name without titles or party affiliations.

SECTION 5. That the Municipal Clerk/Election Superintendent shall “call” the Election by publishing notice of the election in a newspaper of appropriate general circulation.

SECTION 6. That Fulton County Board of Elections and Registration is hereby appointed as the Municipal election Superintendent to conduct the election, to receive from poll officers the returns of the election, to canvass and compute such returns, to certify as soon as practicable following the election the results thereof to the Council, and to take such other actions in the premises as provided by law.

SECTION 7. That the Municipal Clerk is hereby ordered and directed forthwith to furnish the Municipal Election Superintendent of the City with a duly certified copy of this resolution in order that the Municipal Election Superintendent may take such action as provided by law.

SECTION 8. That all resolutions or parts of resolutions on conflict herewith are hereby repealed.
